Nairobi, Kenya, October 18- The High Court has temporarily halted the Senate’s decision to impeach former Deputy President Rigathi Gachagua, following a ruling delivered on Friday by Justice Chacha Mwita. The judge issued a conservatory order suspending the implementation of Gachagua’s impeachment and the appointment of his replacement, Interior CS Kithure Kindiki, until October 24, 2024, when the matter will be revisited in court.
Justice Mwita highlighted that Gachagua’s petition raised important legal and public interest issues, warranting further examination. He directed the Chief Justice to appoint a bench to hear the petition.
“Due to the significance of the issues raised, I certify this matter as involving substantial legal and public interest questions and fit to be heard by a bench of uneven judges, to be appointed by the Hon. Chief Justice,” the ruling read in part.
Gachagua, through his legal team, filed a petition challenging the impeachment process and seeking to block President William Ruto from appointing his replacement. He argued that the process was rushed and denied him the opportunity to defend himself, as he was hospitalized during the Senate’s deliberations on October 17.
The court’s stay order comes just after the National Assembly unanimously approved Kithure Kindiki’s nomination as Deputy President. However, Kindiki’s appointment and swearing-in will now be delayed until Gachagua’s petition is heard and determined.
