Nairobi, Kenya, October 30- The Nairobi High Court has overturned earlier orders that prevented the swearing-in of Prof. Kithure Kindiki as the new Deputy President after the impeachment of Rigathi Gachagua.

These initial orders had been issued by the Kerugoya High Court on October 18, 2024, in response to a petition from David Munyi Mathenge and Peter Gichobi Kamotho, who argued that the situation was of significant national importance and urgency.

On Thursday, a three-judge panel consisting of Justices Antony Mrima, Eric Ogola, and Freda Mugambi ruled in Nairobi, allowing Kindiki’s swearing-in to proceed. The judges indicated that Rigathi Gachagua has the option to appeal this ruling, which is scheduled to be discussed further on November 7, 2024.

In their decision, Justice Ogola stated, “The applications for conservatory orders are hereby disallowed. The conservatory orders issued on October 18, 2024, in Kerugoya High Court are hereby discharged and/or set aside. We grant leave for appeal. Typed proceedings and certified copies of this ruling are to be provided to the parties at their expense. We will mention this matter on November 7, 2024, at 2 PM in open court.”
